Terms & Conditions - Short Term Rental

PROPERTY: 14630 N 44th Street, Phoenix, AZ 85032


1. Maximum Guests allowed (Occupancy) = 8.

People other than those Guests booked, may not stay overnight. Any person other than the Guests is the sole responsibility of the Guest. Guests are not allowed to exceed the occupancy limit agreed to.


2. Guests shall maintain the premises in a good, clean condition, and use the premises in a careful and lawful manner, and shall leave the premises in the same condition as found at the expiration of the rental agreement. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition and agree that the Landlord may deduct costs of said services from the security deposit prior to refund if guests cause damage to the premises or its furnishings.


3. The Landlord has the right to inspect the premises with prior notice as stated with the applicable State laws. Should the Guests violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with State law. Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. Guests shall vacate the premises at the expiration time and date specified on the rental agreement.

4. No pets of any kind to be brought onto the premises


5. No Subletting allowed


6. Guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners and shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Guests shall then immediately vacate the premises. Quiet hour starts at 10 pm to 8 am and outdoor noise should be kept to a minimum.


7. No parties allowed.


8. No smoking or Vaping allowed in the house


9. Guests will be responsible for any damages or loss of the furniture and furnishings, appliances, TV's, PC printers, Wi-Fi and internet equipment, bedding, pictures or fixtures to the wall, outdoor furniture, BBQ, utensils crockery, pots and pans, cutlery etc. Extreme dirt will be classified as damage. This includes any damage caused to the building.

10. A/C & HEATER:  We have set the thermostat for your comfort.

COOLING - set not to go lower than 75º. HEATING -set not to go higher than 72º

Summer time AC thermostat settingsthe thermostat is restricted from going lower than 75 deg FPlease be cognizant of this when booking the house for your stay.

Reasons: Phoenix temperatures in Summer can reach up to 115 deg F. It is impossible for residential A/C systems to cool a house below 75 deg F.

Normal cooling settings, as recommended by AC service companies, for residential thermostats during the Summer in Phoenix, Tempe, Mesa, Tucson and surrounding area are 75 degrees – 80 degrees. To make it more comfortable it is recommended that the fans are kept running – this helps cool and circulate the air.

Why does this matter? Setting the thermostat too low is going to put a lot of stress and wear on the air conditioning system. The AC will have a difficult time keeping up with extreme temperatures in Arizona if it is set too low by running continuously to try to maintain a low temperature setting. This may cause failure of the AC system which will require the guests to find alternate accommodation while the AC is repaired. Please use the fans during the hot months in Phoenix – May through to end September - to help keep the house cool.



11. Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance if such coverage is desired.


12. Guests agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.

13. Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guests do not intend to make the property a residence or household.

14. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.

15. Only legally owned and permitted firearms shall be allowed on the premises according to State and local laws.

16. Guests agrees that Fireworks and other hazardous materials shall not be used or stored in or around the property.

17. Guests shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.

18. The property has fire and carbon monoxide alarms. Guests must notify the Landlord without delay if a fire alarm “chirps” or has a low battery condition.

19. The property is equipped with security cameras at the front entrance and garage for safety.

20. Valuable items left behind by Guests will be held for the Guest and every reasonable effort will be made to contact the Guest for return. If items are not claimed within 2 months, they shall become the property of the Landlord. The Landlord shall not be held liable for condition of said items.

21. Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.

22. High speed wireless internet (Wi-Fi) is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.

23. A Wi-Fi enabled laser printer is provided in the closet in the bedroom facing the road. Please do not remove the printer from the closet. The printer is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for any problems associated with the printer, ink cartridges drying up or needing replacement, access problems, lack of knowledge of use, or personal preferences with regard to or ability to use the printer. Some paper is provided as a courtesy. Please get your own supply of paper if you need additional paper.

24. Payments/Deposits/Refund Policies:
a) Payments for Bookings: To be made at time of finalizing a booking
                                            Refund Policy - 100% of payment refunded if booking cancelled 60 days prior
                                                                    - 50% of payment refunded if booking cancelled 30 days prior
                                                                    - 0% of payment refunded if booking cancelled after (ie 29 days or less prior)
b) Damage Deposit $500 per booking: To be paid on day of arrival. The deposit will be refunded within 7 days of departure, less any damages, breakages, missing items or theft. To be paid by day of arrival. The deposit will be refunded within 7 days of departure, less any damages, breakages, missing items or theft. For bookings, 2 months or longer, the deposit will increase to $1,000.00

25. Cleaning fee - A non-refundable fee of $150 will be charged per booking.
Cleaning required during a longer stay (Booking) - The Owners can arrange a cleaning schedule as required by the Guests. The fee for this will be an additional fee quoted at the time of the request.

26. Universal EV 40 Amp Level 2 - The EV Charger is provided as a convenience only and is not integral to the rental agreement. No refund of rents shall be given for any problems associated with the EV Charger.

TERMS & CONDITIONS FOR THE USE OF THE EV CHARGER

Term EV refers to – Electric Vehicles.

DISCLAIMERS:

The EV Charger and the EV Charger’s Service (“Charger”) is provided “as is” and “as available.”

Tinshack One LLC (Owner) make no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Charger provided or that the Charger will be uninterrupted, reliable, up-to-date, available or operational at any particular time, or that the Charger will be error-free, virus-free or free of other harmful components.

The Guest(s) (also referred to as “You”, “Your”) agree that the entire risk of any and all damage or loss arising out of your use of or inability to use the Charger remains solely with you.

As a condition of your use of the Charger, you warrant that you are at least 16 years of age.

You are solely responsible for ensuring that your EV’s battery is sufficiently charged to meet your needs and that all charging is done in accordance with the auto manufacturer’s recommendations regarding the type, frequency and duration of charging.

INDEMNIFICATION

You agree to indemnify and hold harmless the Owner from and against all any and all actions, causes of action, claims, demands, losses, costs, damages, deficiencies, judgments, liabilities, penalties, fines, assessments, and expenses (including, without limitation, attorney’s fees and costs of litigation) which they or any of them suffer or incur resulting from, by reason of, arising out of or in connection with: (i) your access and use of the Charger, (ii) your violation of the terms, (iv) your violation of any applicable laws or rights of any third party, or (v) any actual or prospective claim, litigation, investigation, or proceeding relating to any of the foregoing, whether based on agreement, tort, or any other theory, whether brought by a third party or by you.

LIABILITY

Guests shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the Charger regardless of the nature of the accident, injury or loss.

By accessing or using the Charger, you agree to be bound by the Terms and Conditions. If you do not agree to the Terms & Conditions do not access or use the Charger. The Terms & Conditions expressly supersede any prior agreements, understandings, or arrangements with you regarding the Charger.
